These Terms of Use (“Terms”) govern your access to and use of https://thrivepsychservices.org (the “Site”), operated by Thrive Psychological Services (“Thrive,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Informational Use Only
The Site provides general information about our practice and allows you to contact us, submit referrals, and request appointments. Content on the Site is for informational purposes only and is not a substitute for professional medical or mental-health advice, diagnosis, or treatment. Reading or interacting with this Site does not create a clinician-patient relationship.
If you are in crisis or experiencing a medical or psychiatric emergency, call 911 or go to the nearest emergency room. You may also call or text the 988 Suicide & Crisis Lifeline.
Booking & Appointments
When you book through the Site, you are submitting a request. Your appointment is confirmed only after our team verifies availability, confirms insurance benefits where applicable, and communicates confirmation to you. Holding a time slot online does not by itself create a confirmed appointment or establish coverage.
You agree to provide accurate, current, and complete information during intake and to update us promptly when it changes. Submitting false or misleading information may result in cancellation of your appointment.
Cancellations & No-Shows
We ask that you provide at least 24 hours’ notice when canceling or rescheduling. Late cancellations and missed appointments may incur a fee, as described in your signed treatment agreement. Specific cancellation policies will be shared at the time of booking.
Telehealth
We offer telehealth services to clients located in California at the time of service. You are responsible for ensuring you have a private setting, reliable internet, and a working device for telehealth sessions. Telehealth has limitations, and certain clinical situations may require in-person care or referral. Your clinician will discuss what is appropriate for your care.
Insurance & Payment
We work with many major insurance plans. Coverage, copayments, deductibles, and out-of-pocket responsibility are determined by your insurance carrier. We verify benefits as a courtesy, but ultimate responsibility for charges rests with you. Self-pay rates and fee schedules are available upon request.
Communications
By providing your contact information, you consent to receive service-related communications from us, including appointment confirmations and reminders by email, phone, or SMS. Email and text messages are not fully secure; please do not include sensitive clinical information in unencrypted communications. Our team will follow up through secure channels as needed.
Intellectual Property
The Site, including text, images, logos, and design, is owned by or licensed to Thrive Psychological Services and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Site without our prior written permission, except for personal, non-commercial use as expressly permitted by these Terms.
Acceptable Use
You agree not to use the Site to:
- Violate any applicable law, regulation, or professional standard.
- Submit false, misleading, or unauthorized information about yourself or another person.
- Attempt to gain unauthorized access to any part of the Site, our systems, or accounts of other users.
- Interfere with or disrupt the integrity, performance, or security of the Site.
- Use automated means to access, scrape, or extract content from the Site without our written permission.
Third-Party Links & Services
The Site may link to third-party websites or use third-party services (such as scheduling platforms, telehealth platforms, or maps). We are not responsible for the content, privacy practices, or terms of those third parties. Use of third-party services is governed by those parties’ own terms.
Disclaimers
The Site is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Limitation of Liability
To the fullest extent permitted by law, Thrive Psychological Services and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including lost profits, lost data, or interruption of service, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of these Terms or your use of the Site will not exceed the amount you paid us, if any, in the twelve months preceding the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.
Indemnification
You agree to indemnify and hold harmless Thrive Psychological Services and its affiliates from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of any third party.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or your use of the Site will be brought in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by a new “Last updated” date at the top of this page and will become effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
